A question of consent
Consent is central in the majority of sexual offence & rape cases. For a defendant to be convicted, the jury must be convinced that the defendant did not reasonably believe that the complainant consented to the act in question. Demonstrating to the court that the defendant reasonably believed that consent was present is therefore a powerful defence against the allegation.
