I find that so many people are on the cusp of qualifying for Legal Aid and whether to remain with their Legal Aid lawyer, perhaps someone who has assisted them as a Duty Solicitor at the Police Station or whether to pay privately.
Legal Aid solicitors, Counsel and High Court Advocate are restricted in relation to the amount of money that they can charge for a case.
Sexual offence cases are, like any other, based upon the number of pages of evidence that the Prosecution use in a case and in any sexual offence case, those pages are, more often than not, low in number.
They do not include the unused material which could go into hundreds, if not thousands, of pages on occasions.
Therefore, with the fixed fees that are available via the Legal Aid Agency (LAA), time is constrained by the Legal Aid Agency.
Where a Legal Aid solicitor and/or barrister may be able to afford you an hour or two in conference for the purpose of taking instruction and drafting a very important document known as a Defence Statement, we can spend several hours, if not days with you to go through your instructions, speak to witnesses that you mention may be of assistance to you, make note of documents that you require by way of third party disclosure and seek that disclosure from the Prosecution and other parties.
Unlike some solicitors, I am not, and we are not, defending people to try to gain celebrity status.
We defend people as though it is some kind of vocation.
Of course, we are in business and we get paid for what we do however, there is little by way of a better feeling that having a client acquitted.
I/we have an excellent success rate when defending people at trial which I believe is based on the hard work, dedication and attention to detail that we put into the preparation of the case in anticipation of the trial commencing.
